Welcome to mimispartypalace.com (the “Website”), operated by Mimi’s Party Palace LLC (“we,” “us,” “our,” or “the Company”).

By accessing, browsing, or using this Website, you (“you” or “the Customer”) acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (“Terms”) and our Privacy Policy. If you do not agree to these Terms, you must not use this Website.

1. Use of the Website

This Website is provided for the purpose of informing customers about our party and event rental services and to facilitate the quote request process.

You agree to use the Website only for lawful purposes. Any fraudulent, speculative, or law-infringing use is prohibited.

2. Booking and Service Process

  1. Quote Request (Wishlist): Submitting a “Wishlist” through our Website does not constitute a confirmed reservation. It is a request for a quote and is subject to item availability and our minimum order requirements for delivery.
  2. Formal Quote: Our team will review your request and send you a formal quote that will include rental costs, applicable taxes, and any delivery or additional service fees.
  3. Booking Confirmation: To confirm a reservation, the Customer must accept the formal quote and pay a 50% non-refundable deposit of the total order. The reservation is not secured until this deposit has been received.
  4. Final Payment: The remaining payment balance must be made no later than two (2) weeks prior to the scheduled event date.

3. Binding Agreements and Policies

By placing a reservation with Mimi’s Party Palace, you agree to be legally bound by the following documents, which are incorporated in their entirety into these Terms by reference:

It is your responsibility to read and understand all of these documents before confirming your reservation.

4. Payments, Cancellations, and Refunds

  1. Payments: We accept payments via Zelle, Apple Pay, PayPal, Venmo, and credit/debit cards.
  2. Cancellation and Refund Policy: The initial 50% deposit is non-refundable under any circumstances. If the Customer cancels the order, the deposit will not be returned. All payments made are final.

5. Customer Responsibility

  1. Care of Equipment: The Customer is responsible for all rented items from the time of delivery (or customer pick-up) until the time of return to our staff.
  2. Weather Protection: The Customer is solely responsible for protecting all rented items from inclement weather (rain, high winds, hail, extreme sun, etc.). The Customer will assume the full cost of replacement or repair for items damaged by weather.

6. Intellectual Property

All content on this Website, including but not limited to text, graphics, logos, images, audio clips, and software, is the property of Mimi’s Party Palace LLC or its content suppliers and is protected by copyright and other intellectual property laws.

You may not modify, copy, distribute, transmit, display, reproduce, publish, license, or create derivative works from any content obtained from this Website without our express written permission.

7. Limitation of Liability

Mimi’s Party Palace LLC shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use this Website or our rental services, beyond the terms specified in our Rental Agreement.

Our maximum liability to you for any claim arising from our services is limited to the total amount paid by you for those services.

8. Indemnification

You agree to indemnify, defend, and hold harmless Mimi’s Party Palace LLC, its officers, directors, employees, and agents, from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your breach of these Terms or your use of our services.

9. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting to the Website. Your continued use of the Website after such modifications will constitute your acceptance of the new Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the state of Texas, without giving effect to its conflict of law principles. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Williamson County or Travis County, Texas.
