Rental Agreement
Ownership & Pickup Access
All rented items are the property of Mimi’s Party Palace LLC and are provided to you for the rental period stated on your order. If you need more time, you must contact us in advance to request an extension—additional charges will apply. Rented items must be made available for pickup at the scheduled time. If items are not returned or accessible when scheduled, Mimi’s Party Palace LLC reserves the right to retrieve our property without prior notice, and you agree not to hold us liable for this action. If our team is unable to retrieve the items during the scheduled pickup window and must return at a later time, an additional pickup fee will apply. Any attempt to hide, sell, or withhold rented items may be considered theft and reported to the appropriate authorities. You are responsible for any legal or collection costs resulting from failure to return items.
Use & Liability
By renting from Mimi’s Party Palace LLC, you confirm that you understand the proper and safe use of all rented items. Equipment must only be used at the event address listed on your order and solely for its intended purpose. Use of all rental items is at your own risk. Mimi’s Party Palace LLC is not responsible for any injuries, damages, or accidents that occur during use. You agree to release and indemnify Mimi’s Party Palace LLC from any claims, losses, or liabilities—including those involving injury, property damage, or death—arising from the use or misuse of our equipment. No warranties, whether expressed or implied, are provided.
Responsibility for Items
From the moment items are delivered or picked up until they are returned, you are fully responsible for their care and condition. This includes ensuring items are protected from weather, theft, misuse, or damage. Any lost, stolen, or damaged items—regardless of fault—must be paid for in full. Charges may include replacement costs, labor, and any applicable shipping fees. Mimi’s Party Palace LLC reserves the right to assess and invoice for damages after items are inspected.
Proper Use of Tents, Tables & Chairs
All rented tents, tables, and chairs must be placed on a smooth, level, and compatible surface such as concrete, asphalt, or short grass. We do not allow setup on rocky, muddy, sloped, or uneven ground. Once placed by Mimi’s Party Palace LLC staff, tents may not be moved by the renter under any circumstances. For your safety, immediately vacate the tent during thunderstorms, lightning, or high winds. Do not use tents during strong winds, especially those exceeding 70 MPH, as even properly anchored tents may become unstable and cause serious injury. Use may resume only after conditions are safe. It is the renter’s responsibility to follow all city safety regulations and event permitting requirements.
Return Conditions
Clients Picking Up & Returning Rental Items to Mimi’s Party Palace LLC
- Dishware, glassware, and food service items must be free of food particles and liquid, and returned in their original containers.
- Linens must be dry, shaken out, and free of debris. Clients are responsible for returning the plastic bags and hangers provided with the linen rental.
Clients Receiving Delivery & Pickup Service
All rented items must be placed in the same location where they were delivered, neatly stacked, broken down, and organized for pickup.
- Dishware, glassware, and food service items must be wiped or rinsed, and returned in their original containers.
- Linens must be dry, shaken out, and free of debris. Clients are responsible for returning the plastic bags and hangers provided with the linen rental.
Failure to follow these return instructions may result in additional cleaning or replacement charges. A starting fee of $25 will be applied for any missing or unreturned linen bags or hangers.
Damage Security Deposit
A refundable damage security deposit will be added to your order. The amount starts at $60 and increases based on the type and quantity of items rented. This deposit helps cover accidental damage, late returns, cleaning, restacking, and missing or unreturned items.
What the Damage Deposit Covers
This deposit applies to all rentals and may be withheld—partially or in full—if any of the following occurs:
- Items are damaged, missing, or not returned
- Late returns or failure to make items available for pickup, affecting future rentals
- Items are dirty or require additional cleaning (e.g., tape, string, food, marker, pen, etc.)
- Items are not restacked or repacked properly
- Hangers, linen bags, crates, clips, ties, or packaging materials are missing (starting at $25)
- Items are repainted, altered, or used improperly (e.g., using indoor items outdoors)
- Items returned with pet hair, odors, moisture, or smoke damage
If the cost to replace or repair the item(s) exceeds the amount of the deposit, the client will be responsible for paying the full remaining balance.
For Clients Returning Items to Mimi’s Party Palace LLC
- All items must be returned to the same location and spot where they were originally picked up
- Items must be repacked in the containers they were provided in
- Follow all cleaning, restacking, and packaging guidelines above to avoid deductions
For Clients Receiving Delivery & Pickup Service
- Items must be placed in the same location where they were delivered
- For standard pickup, items must be neatly stacked, broken down, and ready for pickup
- Items must follow all return condition guidelines to avoid additional charges
Refund Timeline
- Damage deposits are refunded within 4 business days after a full inspection is completed
- For linen orders, please allow up to 15 business days for inspection and processing, as linens are laundered weekly
FYI: Fewer than 2% of rentals result in a withheld deposit—most clients follow the guidelines with no issues!
Force Majeure
Mimi’s Party Palace LLC is not responsible for delays, cancellations, or changes due to circumstances beyond our control, including but not limited to natural disasters, severe weather, government restrictions, public health emergencies, acts of God, war, terrorism, riots, civil unrest, labor strikes, or other extraordinary events. If your event is canceled, postponed, or otherwise impacted due to a force majeure event, no refunds will be issued for payments already received. However, Mimi’s Party Palace LLC will make every reasonable effort to work with the client to reschedule and fulfill the rental agreement at a later date.
Payment Terms
Full payment must be received prior to the rental date unless otherwise agreed in writing. Accepted forms of payment include credit card, debit, or other pre-approved methods. No rentals will be released without full payment.
Cancellation Policy
I understand that cancellations made more than 72 hours after placing my order are non-refundable.
If I cancel within 72 hours, a 10% restocking fee will be deducted from my refund.
Setup & Breakdown
Tents must only be moved by the Mimi’s Party Palace LLC team. Clients may not relocate tents on their own for safety and liability reasons.
Please provide us with a diagram indicating where you’d like your items placed. Once the MPP team sets up the items as requested, we will not be able to move them again without additional charges. You’re welcome to rearrange anything after our team has completed setup and left. Please note, if our team is required to reposition items after the initial setup, additional fees will apply.
If setup and/or breakdown services are purchased, clear and safe access must be provided. If setup is delayed due to blocked access, unsafe conditions, or unprepared grounds, Mimi’s Party Palace LLC reserves the right to cancel or adjust services without refund.
Weather Conditions
Client is responsible for monitoring weather forecasts and making arrangements to protect rental items. Mimi’s Party Palace LLC is not liable for damage caused by weather or unsafe conditions due to wind, rain, or heat unless setup was performed incorrectly by our team.
Unauthorized Use
Rental items may not be used for illegal activity, on rooftops, near open flames (unless approved), or in any way that contradicts their intended use. Misuse will result in forfeiture of deposit and may result in additional charges.
Final Agreement
By placing an order through our website, over the phone, or in person, you confirm that you have read, understood, and agree to be bound by the terms of this Rental Agreement.
This agreement, along with your order confirmation, represents the entire contract between you and Mimi’s Party Palace LLC. No changes, verbal or written, will be valid unless agreed to in writing by Mimi’s Party Palace LLC.
You are responsible for verifying that your rental order is complete and accurate at the time of pickup or delivery. Any missing or incorrect items must be reported to us on the same day—preferably at the time of pickup or delivery. If there is an issue, text us right away so we can resolve it as soon as possible. There will be no refunds, credits, or adjustments for issues reported after the rental day or after the event has ended.
There are no refunds for forgotten or left-behind items.
Governing Law
This agreement is governed by the laws of the State of Texas. By submitting your order or using our rental services, you agree to these terms and to resolve any disputes in the courts of Williamson County or Travis County, Texas.
