Damage Waiver Policy

1. What is the Damage Waiver?

The Damage Waiver is a mandatory 10% fee added to all rental orders. It relieves the Customer of liability for accidental damage to rented items during the normal course of their event. This fee is non-refundable and is paid at the time of booking.

Note: This waiver is not insurance and does not eliminate the requirement for a valid credit card to be kept on file for damages not covered by this policy.

2. Coverage (What is included)

The Damage Waiver covers the cost of repair or replacement for:

  • Accidental breakage of glassware, china, or crystal.
  • Minor stains on linens that can be removed by professional cleaning.
  • Accidental minor scuffs, chips, or surface damage to furniture, backdrops, and decor items.

3. Exclusions (What is NOT included)

The Damage Waiver does not cover the following scenarios. The Customer remains 100% liable for the full replacement cost of items in these cases, which will be charged to the Card on File:

  • Theft or Loss: Any items not returned to Mimi’s Party Palace (including items stolen from the venue or lost during the event).
  • Gross Negligence: Damage caused by intentional misuse, abuse, vandalism, or using equipment for purposes other than intended.
  • Weather Damage: Damage caused by leaving items exposed to rain, wind, hail, or extreme sun. Customers are responsible for moving items to a safe, covered location during inclement weather.
  • Mysterious Disappearance: Items that are missing at the time of pickup/return.
  • Candle Wax: Heavy wax damage on linens or furniture that renders the item unusable or requires specialized restoration.
  • Packing Materials: Loss or damage to crates, racks, bags, hangers, or any containers used for transport.

4. Mandatory Card on File & Claims

For this policy to be effective, the following conditions must be met:

  1. Card on File: The Customer must call Mimi’s Party Palace at +1 (512) 797-6873 during the week of their rental (at least 4 business days prior to the event) to provide a valid credit card to be kept on file for exclusions.
  2. Return of Items: The broken or damaged item (including pieces/shards) must be returned to Mimi’s Party Palace.
  3. Reporting: Damage must be reported to our staff immediately upon the conclusion of the event or at the time of pickup.

5. Cost

The fee for the Damage Waiver is 10% of the total rental price. This fee is non-refundable and must be paid in full to secure the rental agreement.
